RE: The tariff classification of narrow warp knit polyamide pompom trim from China

Dear Mr. Adams:

In your letter dated November 15, 2010, you requested a tariff classification ruling.

The submitted sample is identified as item number 123323 (Trim, Pompom, Tangerine Tango). Information provided in your original request and subsequent emails state that this trim is made on a warp knitting machine, in one operation. As the trim is knitted, a bundle of yarn is hooked out and formed into a circle, creating the pompom effect. CBP laboratory analysis indicates that this trim is composed wholly of textured polyamide filament yarns and measures 0.7 centimeters in width. Your correspondence indicates that this item will be imported in 5 yard lengths, wound around a circular paper board flange that is spooled on a plastic core. It will be used in the craft industry as decorative trim.

In your submission you suggest classification under subheading 5808.90.0010 of the Harmonized Tariff Schedule of the United States, (HTSUS). However, classification under that subheading is precluded as it specifically states “other than knitted or crocheted,” and this trim is knitted.

The applicable subheading for item number 123323, Pompom Trim, will be 6003.30.6000, HTSUS, which provides for knitted or crocheted fabrics of a width not exceeding 30 cm, other then those of heading 6001 or 6002: of synthetic fibers: other. The rate of duty will be 7.6% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
